Court restrains PDP over Enugu delegates’ list

An Enugu High Court has restrained the Peoples Democratic Party from acting on a list of delegates said to have been elected during the recent ward and local government congresses in Enugu State, pending the hearing and determination of a substantive suit on the matter.

The development is a new twist in the battle between two factions – one loyal to Governor Sullivan Chime, the other backed by the Deputy Senate President, Senator Ike Ekweremadu – over control of the party structure in the state.

The Ekweremadu faction, led by Elder David Aja, had declared that the congress held successfully in the state, and proceeded to forward a list of delegates elected from the exercise to Abuja.

But the Chime camp, led by Chief Ikeje Asogwa, insisted that there was no congress in the 260 wards in Enugu State on November 1.

The Chime faction, which includes members of the State Executive Committee of the party, is arguing that the congress did not hold due to the non-arrival of members of the electoral panel and materials from Abuja.

A statement from the Government House on Thursday disclosed that the Enugu High Court, presided by the Chief Judge of the state, Justice Innocent Umezuluike, has stopped the national leadership of the party from acting on the list while ruling on an application filed by one Charles Okafor.

PDP was cited as the defendant in the suit.

Okafor had approached the court to challenge the validity of the said congress.

In the ruling, Umezuluike also ordered an accelerated hearing of the substantive suit.

Stressing the urgency of the matter, the judge further granted the plaintiff seven days within which to file his statement of claim and serve same on the defendant, and equally granted the defendant 14 days to file its statement of defence and serve same on the plaintiff.

Umezuluike adjourned the matter to December 8 for definite hearing.

The delegates said to have been elected from the congress had already approached an Abuja Federal High Court with a suit in which they sought to stop the national leadership of the PDP from changing the result of the exercise.

But, in a counter-affidavit deposed on its behalf in the suit before the Abuja FHC, the PDP reportedly said the congress did not hold in Enugu.

The party stated that due to a misunderstanding that almost involved fisticuffs among the members of its electoral committee for the congress in Enugu State, the materials for the election did not leave Abuja but were deposited by mutual consent at the Wuse Police station for safe-keeping.

The battle over the structure of the party in Enugu State, which effectively ensued after the resignation of the former chairman, Engr. Vita Abba, has gradually moved to the courts.

Asogwa’s appointment by the SEC as Abba’s replacement was rejected by then deputy chairman, Aja, whose argument that he should be the acting chairman was eventually endorsed by the PDP National Working Committee.

Both factions had already obtained separate court orders restraining each other from acting as the leadership of the party in the state.

An Abuja Federal High Court, at the instance of Aja, had restrained Asogwa from parading himself as the chairman of the Enugu State chapter of the PDP, while an Enugu High Court, following an application by Asogwa, also ordered Aja to stop acting as the state party chairman.

Nigerian leaders responsible for B’ Haram –Falana

A Senior Advocate of Nigeria, Mr. Femi Falana, has lambasted political leaders in the country for the loss of thousands of lives to Boko Haram sect.
Falana said the leaders promoted religion to the detriment of the unity of the people.
Falana spoke on Wednesday at the 7th edition of Emeritus Prof. David Ijalaiye (SAN) and celebration of his 50th year anniversary at bar and academics.
The programme was organised by Equity Chambers of Obafemi Awolowo University, Ile –Ife, with Justice Amina Augie chairing the occasion.
Falana cited the building of mosque and church at the Aso Rock Presidential Villa

and sponsorship of pilgrims to holy lands by governments at all levels as the root of religious division in the country.

He said, “Boko Haram is fighting and Nigeria is not responding. If we were still under military rule, I would have suspected a sabotage. The problem of Boko Haram is the cause of both Muslims and Christians. We have allowed religion to outshine our reasoning and we now base our fairness on religious ground. There is no law that states that government shall sponsor anybody for religious purposes.
“Nigeria is a secular state, which allows the right to religion. You are allowed to worship the way you like and go to heaven the way you want without force. But in our case, while (ex-dictator, Gen. Ibrahim) Babangida built a mosque, (former President Olusegun) Obasanjo built a church in the Aso Rock Villa and they are sponsoring them with government fund, they appointed Imams and chaplains respectively.
“Every region in Nigeria is currently faced with its own insurgent groups, most of which are allegedly sponsored by government officials; and the challenge is usually that when you sponsor thugs, it will get to a stage when you lose control and that was what happened with the Boko Haram sect.”
Falana said it was embarrassing that President Goodluck Jonathan has constantly been ill advised and unduly commended for his failure to tackle Boko Haram.

The All Progressives Congress has said that the ruling Peoples Democratic Party has ruined Nigeria in its 16 years of governing the country.
The National Chairman of the party, Chief John Odigie-Oyegun, who said this at an event to mark the six-year anniversary of the Edo State Governor, Adams Oshiomhole, in Benin, explained that the country had come under hardship in the hands of the Federal Government.
Oyegun lamented that the security situation in the country’s North-East region had continued to worsen by the day despite the presence of the nation’s armed forces.
He said, “Today, the country is being destroyed by the totally clueless, totally purposeless and totally lost PDP.
“The whole town of our Chief of Defence Staff, and Mubi were taken without a single shot being fired.
“The insurgents just walked into Mubi because on political instruction, it seemed that there was no attempt to defend Mubi.”
He commended the state governor for facilitating development in a state which, he said, had suffered neglect under the 10-year leadership of the PDP in the state.
“We are sure the APC is going to win the federal elections in February 2015. I want to tell you the APC will form the next government of this nation, Nigeria,” he added.
On his part, the National Leader of the party, Asiwaju Bola Tinubu, accused the PDP-led Federal Government of starving the APC states of funds, with the purpose of hindering development.
He also faulted the Federal Government’s attitude towards the security challenges in the country and the sufferings of the people in the North-East.
He said that President Goodluck Jonathan had shown that he was insensitive to the plight of the people of Potiskum in Yobe State, who recently lost 46 students to insurgency, by “stepping on their blood and dancing on their graves” when he declared his intention to contest the next year’s presidential election on Tuesday.
“A wise President will stay in the Villa, make the broadcast of his intention to run in the memory of those children.
“He is saying that he will not step on the blood of anybody to be re-elected but he is dancing on their blood.
“No leadership of any nation will sit idle and watch any part of his own territory being taken away by the so-called insurgents.
“Mubi is the second largest commercial town in Adamawa State. If it has been taken by the insurgents, then Mr. President should resign. The bragging of the PDP is empty brag, is a lie, PDP is a peoples destruction party, is a poverty development party,” Tinubu said.
The former governor of Lagos State also described the Independent National Electoral Commission as a siamese twin to the PDP, accusing it (INEC) of creating zero polling units to rig the 2015 general elections instead of creating polling booths close to the voters.
Also speaking, a national leader of the party, Chief Audu Ogbeh, said that he left the PDP because the party had been turned into a “mafia” and had failed in also sectors in the country.
On his part, the Speaker of the House of Representatives, Alhaji Aminu Tambuwal, assured the people that the APC would sweep out the ruling PDP next year because the current political system in the country was malfunctioning.
